Terms of Service

The agreement

These terms govern the use of FlowChat, provided by FlowChat. By creating an account or using the software, you agree to them. If you are agreeing on behalf of a business, you confirm you are allowed to.

What the service is

FlowChat lets a business build interactive forms and send them to people through WhatsApp, and records the answers. The service connects to Meta's WhatsApp Business Platform using credentials the business supplies.

The business's responsibilities

You must own or be entitled to use the WhatsApp number you connect. Connecting a number you have no right to use is a breach of these terms.
You must comply with Meta's terms for the WhatsApp Business Platform, including its messaging, template and opt-in policies. Meta can restrict or ban a number, and that is outside FlowChat's control.
You are responsible for what your forms ask. Do not collect sensitive information you are not lawfully entitled to collect, and do not use the service to send unlawful, misleading or unsolicited messages.
You must have a lawful basis for contacting the people you send forms to, and must honour requests to stop.
You are responsible for your own account security, including keeping your access tokens and API keys secret.

Acceptable use

The service must not be used to:

send spam, or messages to people who have not agreed to receive them;
impersonate another person or business;
distribute malware, phishing content or fraudulent offers;
collect data for the purpose of harassing or profiling individuals;
break any law, or any rule set by Meta.

An operator may suspend or remove an account that breaches these terms, and will say why.

Availability

The service depends on Meta's WhatsApp Business Platform, on the business's own WhatsApp account, and on the server it runs on. FlowChat aims for continuous availability but does not promise uninterrupted service, and is not responsible for outages caused by Meta or by the hosting provider.

Fees

Where a subscription applies, its price and limits are shown in the product before it is taken. Subscriptions renew until cancelled. Cancelling stops future charges; access continues to the end of the period already paid for. Meta's own messaging charges are separate and are billed by Meta.

Your data, and leaving

The data a business collects through its forms belongs to that business. It can be exported from the admin panel at any time. On cancellation or deletion, data is removed in line with the Privacy Policy, and a business can ask for a copy beforehand.

Liability

The service is provided as described in these terms. To the extent the law allows, FlowChat is not liable for indirect or consequential loss, for lost profits or lost business, or for the acts of Meta or of the hosting provider. Nothing here excludes liability that cannot lawfully be excluded.

Changes to these terms

These terms may be updated. Continued use after a change means the updated terms apply, and the effective date at the top of this page will show when they changed.

Governing law

These terms are governed by the laws of Greece, and disputes are subject to the courts there.
